Chacun encaisse cependant des personnes qui vendent leurs services dans ce domaine sans \u00eatre qualifi\u00e9es se font pincer. L\u2019Association suisse des guides de montagne (ASGM) a communiqu\u00e9 dimanche sur un cas remontant \u00e0 quelques ann\u00e9es, qui s\u2019est sold\u00e9 en d\u00e9cembre dernier par une condamnation du Minist\u00e8re public valaisan.<\/p>\n<p>Les faits reproch\u00e9s ont \u00e9t\u00e9 commis entre ao\u00fbt 2021 et ao\u00fbt 2023. Une femme a guid\u00e9 \u00e0 plusieurs reprises des clients \u00e0 travers les Alpes suisses, alors qu\u2019elle ne disposait d\u2019aucune formation pour le faire. Le post de l\u2019ASGM mentionne entre autres les ascensions du Breithorn, de l\u2019Allalinhorn, du Bishorn ou encore du Weissmies, des sommets qui culminent tous \u00e0 plus de 4000 m\u00e8tres.<\/p>\n<p>\u00ab On pense d\u2019abord aux gens qui souscrivent \u00e0 ces courses. Il n\u2019est rien arriv\u00e9, tant mieux. Ils ont eu de la chance \u00bb, l\u00e2che Pierre Mathey, secr\u00e9taire g\u00e9n\u00e9ral de l\u2019ASGM. \u00ab Et puis vient ensuite un sentiment de frustration. Parce que se dire guide sans avoir suivi une formation s\u00e9rieuse et \u00eatre soumis aux obligations s\u00e9rieuses qui en d\u00e9coulent, \u00e7a ne para\u00eet juste pas possible que quelqu\u2019un puisse passer au travers de tout \u00e7a. Et que \u00e7a puisse arriver plusieurs fois sans \u00eatre enregistr\u00e9. \u00bb<\/p>\n<p><strong>Un cas \u00ab emb\u00e9matique \u00bb<\/strong><\/p>\n<p>Pour autant, le cas de figure n\u2019est rien d\u2019exceptionnel pour le secr\u00e9taire g\u00e9n\u00e9ral. Il estime entre dix et vingt les d\u00e9nonciations faites chaque ann\u00e9e \u00e0 l\u2019ASGM pour des doutes concernant les qualifications des guides de montagne. Ces signalements peuvent \u00e9maner de clients des pseudo-guides, du personnel des refuges ou encore d\u2019autres guides qui auraient crois\u00e9 leur chemin &#8211; dans le cas pr\u00e9sent, un guide bernois et des clients on t\u00e9moign\u00e9 de leurs doutes. Selon la qualit\u00e9 des preuves qui sonst ensuite collect\u00e9es par l&rsquo;ASGM, l&rsquo;affaire peut se solder par une d\u00e9nonciation p\u00e9nale.<\/p>\n<p>\u00ab Mais le but premier de l\u2019association, ce n\u2019est pas d\u2019entamer une proc\u00e9dure judiciaire, temp\u00e8re Pierre Mathey. Sur la vingtaine de d\u00e9nonciations annuelles, la moiti\u00e9 est g\u00e9n\u00e9ralement instruite. Dans 80% des cas restants, l\u2019affaire est r\u00e9gl\u00e9e en interne. Certaines personnes nous disent qu\u2019elles n\u2019\u00e9taient pas au courant des lois en vigueur. Que ce soit vrai ou pas, notre but est surtout de remettre de l\u2019ordre dans les offres qui dysfonctionnent. \u00bb<\/p>\n<p>Reste alors les personnes qui ne veulent pas entrer en discussion \u2013 c\u2019est le cas de notre fausse guide. Le Minist\u00e8re public est alors saisi et enqu\u00eate de son c\u00f4t\u00e9. \u00ab On est face \u00e0 un des cas qui a abouti. Ce n\u2019est pas le premier, mais il est assez embl\u00e9matique, car l\u2019activit\u00e9 de guide \u00e9tait men\u00e9e largement par la personne, analyse Pierre Mathey.<\/p>\n<p>En Suisse, des condamnations similaires ont d\u00e9j\u00e0 \u00e9t\u00e9 prononc\u00e9es dans les cantons de Berne, des Grisons et du Valais. Selon le secr\u00e9taire g\u00e9n\u00e9ral de l\u2019ASGM, le montant des amendes dans les pr\u00e9c\u00e9dentes affaires en Valais \u00e9tait d\u00e9j\u00e0 de 5000 francs, comme pour la guide condamn\u00e9e en d\u00e9cembre. \u00ab Mais pour une personne qui vient d\u2019un pays o\u00f9 les revenus sont bien inf\u00e9rieurs, ce n\u2019est pas rien. Et c\u2019est inscrit comme infraction. \u00bb<\/p>\n<p><strong>Le r\u00f4le des r\u00e9seaux sociaux<\/strong><\/p>\n<p>La condamn\u00e9e n\u2019est pas de nationalit\u00e9 suisse, ni europ\u00e9enne. Elle a \u00e9t\u00e9 jug\u00e9e en Valais non pas parce qu\u2019elle habitait le canton, mais parce que les infractions qui lui sont reproch\u00e9es dans le dossier ont eu lieu sur le massif du Mont Rose.<\/p>\n<p>Pour Pierre Mathey, les prix pr\u00e9f\u00e9rentiels que proposent ces guides non autoris\u00e9s participent \u00e0 attirer les clients. \u00ab Mais il existe aussi une exploitation plus culturelle : les prestations sont souvent vendues sur Facebook, \u00e0 des personnes parlant la m\u00eame langue que le pseudo-guide. Il y a une part de m\u00e9connaissance de ce qu\u2019est le m\u00e9tier de guide en Suisse chez ces clients. \u00bb<\/p>\n<p>Le secr\u00e9taire g\u00e9n\u00e9ral remarque d\u2019ailleurs clairement une hausse de ces cas allant de pair avec le d\u00e9veloppement des r\u00e9seaux sociaux, o\u00f9 ces faux guides s\u2019affichent d\u2019ailleurs souvent. \u00ab Au d\u00e9but, on se disait : ce n\u2019est pas possible, ils ne font quand m\u00eame pas \u00e7a. Mais en fait oui : pour que quelqu\u2019un les trouve, il n\u2019est pas le choix. \u00bb<\/p>\n<p>Pour accompagner ce changement de paradigme, l\u2019ASGM a lanc\u00e9 un projet pilote visant \u00e0 digitaliser les cartes de guide. \u00ab Jusqu\u2019\u00e0 l\u2019ann\u00e9e pass\u00e9e, on avait une carte physique avec nom, pr\u00e9nom, activit\u00e9 et une petite photo du membre reconnaissable. On l\u2019appelait des timbres de validit\u00e9 annuelle. La nouvelle carte digitale a l\u2019avantage de ne pas \u00eatre dupliqu\u00e9e et de contenir plus d\u2019informations.
